Revisions to Surfside Bylaws to be approved by the membership at the April 24, 2021 Annual Meeting
** The existing Bylaws were written to accommodate eventual application for IRS classification as an IRC 501(c)(3) charitable organization that would permit donors to treat donations to Surfside as charitable deductions on their individual IRS 1040 forms. Discussions by the Board over the past several years determined that there was little or no interest in Surfside becoming a fund-raising organization that would justify the $800 application cost plus likely attorney fees to obtain 501(c)(3) status. Further, Surfside’s targeted opportunity for young player development is MBHS Tennis, already a 501(c)(3) entity where individual donations are currently deductible. Therefore, it is recommended to revise ARTICLE II.1 as follows:
1. Surfside is organized and operated exclusively for the purposes set forth in Article II hereof within the qualified amateur sports organization meaning of Internal Revenue Code section 501 (C)(3) and supporting the Girls and Boys Tennis Teams at Morro Bay High School to develop athletes for tennis competition.
1. Surfside is classified under CA Code 23701g and IRC 501(c)(7) as a social and recreational organization operated exclusively for the purposes set forth in Article II including supporting the Girls and Boys Tennis Teams at Morro Bay High School to develop athletes for tennis competition.
**Likewise, it is recommended to revise ARTICLE VI.5. by eliminating individual income tax deduction reporting duties for the Treasurer and clarifying responsibility for club insurance and regulatory duties as follows:
5. The Treasurer shall collect all dues and, with the help of the Secretary, advise members of delinquencies and terminations. The Treasurer shall maintain financial records and report to the board and membership. The Treasurer shall manage insurance, regulatory, and tax issues..To facilitate timely individual income tax filing, the Treasurer shall inform members concerning the proportion of dues that meet the criteria for charitable deductions by February 15 of each year. The Treasurer shall propose an annual budget including current status, forecast of revenues, and itemized anticipated expenses.
**Additionally, to make the Bylaws consistent with Club practices as evolved over the past several years and to emphasize expectations for the performance of Appointive Directors, the following revisions are recommended for ARTICLE VII:
1. Appointive directors ’ responsibilities include: Publicity, Tournaments, Social, Membership, Editor, Historian, Central Coast Women’s Tennis League (CCWTL) and Webmaster.
2. The Publicity Director Editor and Membership Director should shall jointly publicize club activities and participation opportunities.
3. The Tournament Director should shall work with the Vice-President and Social Chairpersons Director in organizing tournaments and post-tournament activities. The Tournament Director facilitates standard Saturday group tennis and coordinates routine court upkeep and maintenance .
4 The Social ActivitiesDirector should shall organize the annual holiday party and other social events.
5. The Editor should shall publish, on a recurring basis, a newsletter containing news about club activities. The Editorshouldshall also prepare any notices of special meetings.
6. The Historian should shall keep a well-ordered scrapbook of club memorabilia, which should shall be made available for general meetings and social events. Photos and photocopies should shall be shared with the Webmaster. The Historian should shall collect and store any records, documents, or chronicles created by retiring officers that may be valuable for future use.
7. The Membership Director should shall prepare and distribute an updated list of all members in October of each year. The Membership Director should shall also facilitate member recruitment and retention.
8. The CCWTL Director should shall organize Surfside’s participation in the Central Coast Women’s Tennis League.
9. The Webmaster(s)should shall maintain and update the club’s information on the club’s website. Attendance at Board meetings is optional at the discretion of the Webmaster(s)
